I sold my mobile home to someone who changed his mind after he paid and I spent the money.?

February 13th, 2010 6 comments

I now owe him the money back, I know, but if the mobile home sells, I believe that I am still the owner and I am the one who will need to write a bill of sale to the new buyer, correct? I wrote him a bill of sale when he first bought it, but doesn’t it revert back to me when he decides he does not want it? I live in Maine and I am still living in the mobile home and all the utilities are still in my name and so are the taxes and the lot rent. Can anyone clarify this for me please?

If you both signed the bill of sale then he has bought himself a mobile home. You need to keep your money and move out of his residence. He cant just change his mind and expect his money back after signing. If you want to let him out of the purchase it’s your choice, not his.

Best of Luck!

I have a question about first time buyer?

February 11th, 2010 3 comments

I bought my first house just recently but my wife has a mobile home that is in her name and being "rented out to own" by current individuals living in it. My wife pays taxes on the mobile home just as well. My question is, do we qualify for first time buyer($8,000) Tax return? Our Home was purchased 31 October 2009.

If anyone can help me or direct me to a link where I can specifically read up on this matter.

No.
For the purpose of this credit, you are first time homebuyer if you (your spouse if married) did not own any other main home during the 3-year period ending on the date of purchase.

can the landlord of my mobile home park not approve prospective buyers of my mobile home so that i would have no choice but to sell it to them for very little money?
does the landlord of my mobile home park have the right to not approval of prospective buyers of my trailer so that i would be forced to sell to them at a huge loss? phoenix, arizona.

You have the right to remove your property form the landlords property if they do not approve of your buyer.

You do NOT have the right to force them to accept anyone on thier private property.

If I move my mobile home will I have to pay back the first time home buyer credit?

February 3rd, 2010 1 comment

I bought a mobile home in May 2009 so I will be getting the first time home buyer credit. I want to move the trailor to another state. Since I will still own the home and will just be moving it do I have to pay back the first time home buyer credit. I have heard both ways. That yes I do because the address would change and no I don’t because I still will be owning the same home.

If you still own it and live in it as your main home, there is no need to repay the credit. Just keep proof of ownership and the transfer from state to state. I’d also keep utility bills in your name at both locations. If IRS inquires, you will have the documentation you need.
